{"id":6375,"date":"2021-03-08T14:44:22","date_gmt":"2021-03-08T14:44:22","guid":{"rendered":"https:\/\/www.iquanta.in\/blog\/?p=6375"},"modified":"2022-02-13T23:46:34","modified_gmt":"2022-02-13T18:16:34","slug":"new-labour-laws","status":"publish","type":"post","link":"https:\/\/www.iquanta.in\/blog\/new-labour-laws\/","title":{"rendered":"New Labour Laws"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Lok Sabha on Sep 26, 2020, cleared new versions of <\/span><span style=\"font-weight: 400;\">three labor codes <\/span><span style=\"font-weight: 400;\">\u2014 <\/span><b><i>Industrial<\/i><\/b><b><i> R<\/i><\/b><b><i>elations Code Bill, 2020, Code on Social Security Bill, 2020, and Occupational Safety, Health<\/i><\/b> <b><i>and Working Conditions Code Bill, 2020.<\/i><\/b><b><i>\u00a0<\/i><\/b><\/p>\n<p><span style=\"font-weight: 400;\">While the government proposes to increase the ambit of social security by including gig workers<\/span> <span style=\"font-weight: 400;\">and inter-state migrant workers, it has also proposed measures that will provide greater flexibility<\/span> <span style=\"font-weight: 400;\">to employers to hire and fire workers without government permission.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>1) Occupational Safety, Health and Working Conditions Code Bill, 2020.<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">It has defined inter-state migrant workers as someone who has willingly come to work to<\/span> <span style=\"font-weight: 400;\">one state from another and is earning up to Rs 18000 a month<\/span><\/span><span style=\"font-weight: 400;\"><span style=\"background-color: #ffff00;\">.<\/span> The proposed definition<\/span> <span style=\"font-weight: 400;\">makes a distinction from the present definition of only contractual employment.<\/span> <span style=\"font-weight: 400;\">(basically, noncontractual workers will also be counted as migrant workers, and will be<\/span> <span style=\"font-weight: 400;\">eligible for benefits).<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The government has, under the code, allowed <\/span><span style=\"font-weight: 400; background-color: #ffff00;\">a single license<\/span><span style=\"font-weight: 400;\"> for staffing firms to hire<\/span> <span style=\"font-weight: 400;\">workers on a contract basis across different locations. Earlier, multiple licenses were<\/span> <span style=\"font-weight: 400;\">needed to hire workers from different states.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So, all in all, this law is a good one. <\/span><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">It simplifies shit(paperwork) for contractors and<\/span> <span style=\"font-weight: 400;\">expands the definition of a migrant worker.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/span><\/p>\n<p><a href=\"https:\/\/www.iquanta.in\"><img decoding=\"async\" class=\"alignnone wp-image-7740 \" src=\"https:\/\/www.iquanta.in\/blog\/wp-content\/uploads\/2021\/12\/WhatsApp-Image-2021-12-16-at-4.09.20-PM-1.jpeg\" alt=\"\" width=\"513\" height=\"97\" srcset=\"https:\/\/www.iquanta.in\/blog\/wp-content\/uploads\/2021\/12\/WhatsApp-Image-2021-12-16-at-4.09.20-PM-1.jpeg 1280w, https:\/\/www.iquanta.in\/blog\/wp-content\/uploads\/2021\/12\/WhatsApp-Image-2021-12-16-at-4.09.20-PM-1-300x57.jpeg 300w, https:\/\/www.iquanta.in\/blog\/wp-content\/uploads\/2021\/12\/WhatsApp-Image-2021-12-16-at-4.09.20-PM-1-1024x194.jpeg 1024w, https:\/\/www.iquanta.in\/blog\/wp-content\/uploads\/2021\/12\/WhatsApp-Image-2021-12-16-at-4.09.20-PM-1-768x145.jpeg 768w, https:\/\/www.iquanta.in\/blog\/wp-content\/uploads\/2021\/12\/WhatsApp-Image-2021-12-16-at-4.09.20-PM-1-640x121.jpeg 640w, https:\/\/www.iquanta.in\/blog\/wp-content\/uploads\/2021\/12\/WhatsApp-Image-2021-12-16-at-4.09.20-PM-1-681x129.jpeg 681w\" sizes=\"(max-width: 513px) 100vw, 513px\" \/><\/a><\/p>\n<p><b>2) The Code on Social Security Bill, 2020<\/b><\/p>\n<p><span style=\"font-weight: 400;\">It intends to provide for <span style=\"background-color: #ffff00;\">u<\/span><\/span><span style=\"font-weight: 400; background-color: #ffff00;\">niversal social security to all workers<\/span><span style=\"font-weight: 400;\">, including the unorganized and<\/span> <span style=\"font-weight: 400;\">the gig and platform workers. Together, these account for over 90 percent of the Indian<\/span> <span style=\"font-weight: 400;\">workforce estimated at 50 crore.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Earlier, workers only in the organized sector were eligible for social security benefits, this is now<\/span><span style=\"font-weight: 400;\"> b<\/span><span style=\"font-weight: 400;\">eing expanded to gig workers too. (unorganized, contract basis workers).<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It proposes a <span style=\"background-color: #ffff00;\">N<\/span><\/span><span style=\"font-weight: 400; background-color: #ffff00;\">ational Social Security Board<\/span><span style=\"font-weight: 400;\"> which shall recommend to the Central Government<\/span> <span style=\"font-weight: 400;\">for formulating suitable schemes for different sections of unorganized workers, gig workers, and<\/span><span style=\"font-weight: 400;\"> p<\/span><span style=\"font-weight: 400;\">latform workers.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also, aggregators employing gig workers will now have to contribute <\/span><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">1-2 percent of their annual<\/span> <span style=\"font-weight: 400;\">turnover for social security.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Eg of gig workers: Swiggy, Amazon delivery people<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is a brilliant move and has been welcomed by all sides.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>3) Industrial Relations Code Bill, 2020(the most controversial one,<\/b> <b>or the only one which has sparked a debate)<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">It seeks to consolidate and amend laws relating to trade unions, conditions of<\/span> <span style=\"font-weight: 400;\">employment, investigation, and settlement of industrial disputes.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the Industrial Relations Code Bill, 2020, <\/span><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">the government has proposed to introduce more<\/span> <span style=\"font-weight: 400;\">conditions restricting the rights of workers to strike<\/span><\/span><span style=\"font-weight: 400;\"><span style=\"background-color: #ffff00;\">,<\/span> alongside <span style=\"background-color: #ffff00;\">an <\/span><\/span><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">increase in the threshold<\/span> <span style=\"font-weight: 400;\">relating to layoffs and retrenchment in industrial establishments having 300 workers from 100 <\/span><\/span><span style=\"font-weight: 400; background-color: #ffff00;\">workers or more at present<\/span><span style=\"font-weight: 400;\"> \u2014 steps that are likely to provide <span style=\"background-color: #ffff00;\">m<\/span><\/span><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">ore flexibility to employers for<\/span> <span style=\"font-weight: 400;\">hiring and firing workers without government permission.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/span><\/p>\n<p><b><i>Earlier, factories or industries with less than 100 workers could hire and fire<\/i><\/b> <b><i>workers, at their own discretion, without adhering to government laws and<\/i><\/b> <b><i>regulations(related to retrenchment and closure).<\/i><\/b><b><i>\u00a0<\/i><\/b><\/p>\n<p><b><i>Now, this limit has been increased to 300 workers, which means more factories<\/i><\/b> <b><i>will be included in this ambit, which means more factories will be able to hire and<\/i><\/b> <b><i>fire workers, as and when they wish.<\/i><\/b><b><i>\u00a0<\/i><\/b><\/p>\n<p><span style=\"font-weight: 400;\">This significantly improves the ease of firing for employers, if they need to cut their costs<\/span> <span style=\"font-weight: 400;\">or close their factories.(earlier firing and closure required govt permission, and a lot of<\/span> <span style=\"font-weight: 400;\">paperwork and hassles, if the no of employees were greater than 100)(now increased to<\/span> <span style=\"font-weight: 400;\">300).<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Standing Committee on Labour, in its report submitted in April, had also suggested hiking<\/span> <span style=\"font-weight: 400;\">the threshold to 300 workers, noting that some state governments like Rajasthan had already<\/span> <span style=\"font-weight: 400;\">increased the threshold and which, according to the Labour Ministry, has resulted in \u201can increase<\/span> <span style=\"font-weight: 400;\">in employment and decrease in retrenchment\u201d<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>What is the Govt\u2019s rationale for increasing the limit?<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The government maintains that fewer people are employed when the threshold limit is<\/span> <span style=\"font-weight: 400;\">100 workers.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the labor minister, it discourages employers to recruit more workers than<\/span> <span style=\"font-weight: 400;\">100, they deliberately keep their workers\u2019 strength below 100. (because otherwise<\/span> <span style=\"font-weight: 400;\">retrenchment, firing, and closure is a very tedious task, requiring a lot of government<\/span> <span style=\"font-weight: 400;\">permissions and paperwork)(so factory owners were not setting up big factories,<\/span> <span style=\"font-weight: 400;\">because in case of potential losses, they would not be able to fire workers as per their<\/span> <span style=\"font-weight: 400;\">needs)(low scale, low productivity)(very very very capitalist argument :p)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The minister also added that investors will be encouraged to set up big factories and<\/span> <span style=\"font-weight: 400;\">employ more workers, after the increase in the threshold limit for \u201chire and fire\u201d from 100 to<\/span> <span style=\"font-weight: 400;\">300.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>CONCERNS AND CRITICISMS<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Analysts say the increase in the threshold for standing orders will water down the labor rights<\/span> <span style=\"font-weight: 400;\">for workers in small establishments having less than 300 workers. \u201cThe increase in the threshold<\/span> <span style=\"font-weight: 400;\">for standing orders from the existing 100 to 300 is uncalled for and shows the government is<\/span> <span style=\"font-weight: 400;\">very keen to give tremendous amounts of flexibility to the employers in terms of hiring and<\/span> <span style=\"font-weight: 400;\">firing\u2026dismissal for alleged misconduct and retrenchment for economic reasons will be<\/span> <span style=\"font-weight: 400;\">completely possible for all the industrial establishments employing less than 300 workers. This is<\/span> <span style=\"font-weight: 400;\">complete demolition of employment security,\u201d XLRI professor and labor economist KR Shyam<\/span> <span style=\"font-weight: 400;\">Sundar said.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">The Industrial Relations Code also introduces new conditions for carrying out a legal strike<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/span><\/p>\n<p><span style=\"background-color: #ffff00;\"><span style=\"font-weight: 400;\">For instance, the IR Code proposes that no person employed in any industrial establishment shall<\/span> <span style=\"font-weight: 400;\">go on strike without a 60-day notice and during the pendency of proceedings before a Tribunal or<\/span> <span style=\"font-weight: 400;\">a National Industrial Tribunal and sixty days after the conclusion of such proceedings.
